Terms of Use Policy

Arbor Broadcasting – Roku App Terms of Use

Last Updated: March 24th, 2026

These Terms of Use ("Terms") govern your access to and use of the Arbor Broadcasting Roku application (the "App") and any content, features, and services made available through the App (collectively, the "Services"). The Services are provided by Arbor Broadcasting ("Arbor Broadcasting," "we," "us," or "our"). By downloading, accessing, or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. Eligibility

You must be legally capable of entering into a binding agreement to use the Services. If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Accounts, Access, and Purchases

Certain features of the Services may require a Roku account, an in-app purchase, a subscription, or other payment arrangement. Any purchases you make may be processed by Roku or another third-party payment provider, and additional terms may apply. You are responsible for all charges incurred through your account and for maintaining the confidentiality of your account credentials.

3. License to Use the Services

Subject to your compliance with these Terms, Arbor Broadcasting grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Services for your personal, non-commercial viewing of the available programming. Except as expressly permitted, you may not (a) copy, reproduce, distribute, publicly perform, or publicly display the Services or any content; (b) record, download, scrape, rip, retransmit, rebroadcast, or create derivative works from any broadcast or stream; (c) circumvent or disable any access controls, digital rights management, or security features; or (d) use the Services for any unlawful purpose.

4. Broadcasts and Content Rights

The Services may include live or on-demand broadcasts of local sporting events, game footage, highlights, audio, commentary, graphics, team information, schedules, and other content (collectively, "Content"). As between you and Arbor Broadcasting, Arbor Broadcasting and its licensors own and retain all right, title, and interest in and to the Services and Content, including all copyrights and other intellectual property rights. Nothing in these Terms transfers any ownership rights to you.

You may view Content only through the Services and only as made available by Arbor Broadcasting. You may not rebroadcast, retransmit, distribute, sell, license, or otherwise exploit the Content, or any portion of it, without Arbor Broadcasting’s prior written permission (and, where applicable, the permission of our licensors and rights holders).

5. User Conduct

You agree not to:

  • Use the Services in any manner that violates any applicable law or regulation.
  • Interfere with, disrupt, or attempt to gain unauthorized access to the Services, servers, or networks.
  • Use any robot, spider, scraper, or other automated means to access the Services.
  • Attempt to circumvent geographic restrictions, access controls, or other restrictions that may apply to the Services or Content.
  • Remove, obscure, or alter any proprietary notices or labels on the Services or Content.

6. Third-Party Platforms and Services (Including Roku)

The App is made available through the Roku platform. Your use of Roku devices, software, services, and any related payments may be governed by Roku’s terms, policies, and settings, which are between you and Roku. Arbor Broadcasting is not responsible for third-party platforms, device performance, network connectivity, or outages that affect your ability to access the Services.

7. Service Availability; Scheduling; Blackouts

Live sports and other programming may be subject to delays, interruptions, cancellation, rescheduling, or unavailability due to factors beyond our control (including venue limitations, technical issues, weather, rights restrictions, or decisions of leagues, schools, teams, or venues). Certain Content may be subject to geographic restrictions, blackouts, or other limitations and may not be available in all locations or at all times.

8. Feedback

If you provide suggestions, ideas, or feedback about the Services ("Feedback"), you grant Arbor Broadcasting a perpetual, irrevocable, worldwide, royalty-free license to use the Feedback for any purpose without compensation or attribution to you.

9. Intellectual Property

The Services, including all text, graphics, logos, user interfaces, audio, video, and software, are owned by Arbor Broadcasting or its licensors and are protected by intellectual property laws. All trademarks, service marks, and logos used in the Services are the property of their respective owners.

10. Copyright Complaints

If you believe that any Content available through the Services infringes your copyright, please send a notice to: ArborBroadcasting@gmail.com. Your notice should include: (a) a description of the copyrighted work you claim has been infringed; (b) a description of where the material is located in the Services; (c) your contact information; (d) a statement that you have a good-faith belief that the use is not authorized; and (e) a statement, under penalty of perjury, that the information is accurate and that you are the owner or authorized to act on the owner’s behalf.

11. Disclaimers

THE SERVICES AND CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, ARBOR BROADCASTING DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT ANY PARTICULAR CONTENT WILL BE AVAILABLE AT ANY GIVEN TIME.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL ARBOR BROADCASTING OR ITS AFFILIATES, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICES OR ANY CONTENT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE MAXIMUM EXTENT PERMITTED BY LAW, ARBOR BROADCASTING’S TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID TO ARBOR BROADCASTING (IF ANY) FOR ACCESS TO THE SERVICES IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

13. Indemnification

You agree to defend, indemnify, and hold harmless Arbor Broadcasting and its affiliates, officers, directors, employees, contractors, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your use of the Services, your violation of these Terms, or your violation of any rights of another.

14. Suspension and Termination

We may suspend or terminate your access to the Services at any time if we believe you have violated these Terms or if we discontinue the Services (in whole or in part). Upon termination, the license granted to you will end. Sections that by their nature should survive termination will survive (including Sections 4, 8–13, and 15–17).

15. Governing Law and Venue

These Terms are governed by the laws of the State of Michigan, without regard to its conflict of laws principles. You agree that any dispute arising out of or relating to these Terms or the Services will be brought exclusively in the state or federal courts located in Washtenaw County, Michigan, and you consent to personal jurisdiction in those courts.

16. Changes to These Terms

We may update these Terms from time to time. The “Last Updated” date above indicates when these Terms were last revised. By continuing to use the Services after changes become effective, you agree to the revised Terms.
